The Company acknowledges that Licensor may use the Software in connection with certain confidential and privileged information. LICENSOR DISCLAIMS ANY AND ALL LIABILITY ARISING FROM THE USE, MISUSE, OR LOSS OF ANY SUCH PRIVILEGED INFORMATION. If any such privileged or confidential information is lost or disseminated as a result of Licensor’s use of the Software, The Company shall not be held liable. It is the responsibility of the Licensee to obtain any necessary consent from any involved third parties (the “Third Parties”), whose data is being placed by Licensee in the Teleneos System. However, such Third Parties shall in no way be considered Third Party Beneficiaries of this Agreement, and such Third Parties shall have no right of action against the Company, and the Company shall have no liability of any kind to such Third Parties regardless of whether or not Licensee grants such Third Parties access to the Teleneos System. Licensee will hold the Company harmless against any and all such claims, including reasonable attorney fees and costs of defense.
